For us, Article6(1)(a) DSGVO servesas the legal basis for processing operations for which we have obtained consent toprocess thepersonal data of a data subject for a specific purpose.

Insofar as the processing of data is necessary for the initiation orperformance of a contract, Article 6 (1) (b) serves asthe legal basis of our processing of personal data.

In addition, alegitimate interest of the controller pursuant to Art. 6 (1) (f) may serveas the legal basis for processing. This is the case if there is no other legal basis for the processing and if the processing is necessary to protect the legitimate interests of the controller or a third party and the interests or fundamental rights and freedoms of the data subject are not overridden.

9 Legitimate interest

Insofar as data processing is carried out on the basis of Art.6 (1) (f) of the DSGVO,ourlegitimate interest isthe performance of the statutory activities of our association for the benefit of our dependent subdivisions, our member clubs and their members.

10. rights of the data subjects

According to the General Data Protection Regulation and the other applicable data protection regulations, you as a data subject of a data processing are entitledto the following rights with regard to your data in accordance with Art.13 DSGVO:

(a) You have a right of access against the controller. As a data subject, you have the right to receive information free of charge at any time from the FLVW as the controller about the personal data stored about you. Pursuant to Art.15 DSGVO, you have the right to obtain information about the purposes of processing, the categories of personal data that are processed, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the planned duration of storage of the personal data, the existence of a right to rectification, erasure, restriction of processing or the existence of a right to object to the processing of the data concerning you.

b) Pursuant to Art.16 DSGVO, you have the right to have anyinaccuratepersonal dataconcerning youcorrected or completed without delay.

c) You also have the right under Art.17 DSGVO to request the erasure ofyour personaldata (right to be forgotten) by the FLVW, unless the processing is necessary for the exercise of the right to freedom of expression and information, the fulfilment of a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

d) You may requestthe restriction of theprocessing of your personal data in accordance with Art.18 DSGVO,

  • if you dispute the accuracy of the personal data,
  • the processing is unlawful, but you refuse to erase your personal data and instead request the restriction of the use of the personal data,
  • if the controller no longer requires the personal data, but you need it to assert, exercise or defend legal claims, or
  • if you have objected to the processing of your data in accordance with Article21 DSGVO, as long as it has not yet been determined whether the legitimate reasons of the FLVW outweigh your legitimate reasons. If one of the aforementioned conditions applies, and you wish to request the restriction of personal data stored by the FLVW, you may at any time contact any employee of the FLVW controller. The employee of the FLVW will arrange the restriction of the processing.

e) You also have the right to data portability pursuant to Article20 DSGVO,according to which you are entitled to obtain from the controller the personal data you have provided in a structured, commonly used and machine-readable format, or to request that it be transferred to another controller.

f) Insofar as the processing of your data is based on consent, you have aright of revocation pursuant to Art. 7 DSGVO,according to which you can revoke your consent to the processing of your data at any time, without giving reasons for the future.

g) You also have the right to lodge a complaintwith thecompetent supervisory authority at your usual place of residence, your place of work or the place of the alleged infringement of the provisions of the DSGVO in accordance with Art.77 DSGVO.

11 Right of objection

You have the right to object according to § 21 DSGVO. You may object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis ofArticle 6(1)(e) or(f) DSGVO. The FLVW shall no longer process the personal data in the event of the objection, unless the FLVW can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.

12 Duration of storage

We do not store your data for longer than is legally permissible. The storage of data is generally permissible for as long as is necessary to achieve the purpose for which it is stored.
According to the German Fiscal Code (Abgabenordnung) and the German Commercial Code (Handelsgesetzbuch), the storage period can be up to 6 or 10 years. If the data processing is based on your consent, we will immediately remove your data from our system in the event that you withdraw your consent.
